Terms & Conditions
1. Scope of Application
These Terms and Conditions (T&C) apply to the use of the projectfit.ai platform, operated by Isar Innovations GmbH, Waldmeisterstr. 31, 80935 Munich, Germany (hereinafter referred to as the "Provider").
2. Services Provided by the Provider
The Provider offers a SaaS platform that enables Customers to match their professional profiles with suitable job opportunities (both permanent and freelance). The platform is accessible via a web browser without requiring installation.
3. Registration and Contract Conclusion
Using the platform requires registration. Customers must provide complete and truthful information. By registering, the Customer submits a binding offer to conclude a contract. The contract is established once the Provider confirms acceptance.
4. Third-Party Authentication Services
Our Services may allow you to authenticate and create an account using LinkedIn's Sign In with LinkedIn service ("Third-Party Authentication"). By using Third-Party Authentication, you agree that:
- Your use of LinkedIn's services is governed by LinkedIn's own terms of service and privacy policy, available at LinkedIn User Agreement (https://www.linkedin.com/legal/user-agreement) and LinkedIn Privacy Policy (https://www.linkedin.com/legal/privacy-policy).
- We are not responsible for LinkedIn's availability, security, or privacy practices.
- You authorize us to access and use certain information from your LinkedIn account as permitted by LinkedIn and in accordance with our Privacy Policy.
Third-Party Service Availability
We do not guarantee the continued availability of Third-Party Authentication services. LinkedIn may modify, suspend, or discontinue their services at any time, which may affect your ability to access our Services using Third-Party Authentication.
Disconnecting Third-Party Authentication
You may disconnect your LinkedIn account from our Services at any time through your account settings. Disconnecting may affect certain features or require you to establish alternative authentication credentials.
No Endorsement
Our integration with LinkedIn does not constitute an endorsement by LinkedIn of our Services, nor does it constitute our endorsement of LinkedIn. LinkedIn and its trademarks are the property of LinkedIn Corporation.
Disclaimer of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY DAMAGES, LOSSES, OR ISSUES ARISING FROM: (a) Your use of Third-Party Authentication services; (b) LinkedIn's collection, use, or disclosure of your information; (c) Any interruption, suspension, or termination of LinkedIn's services; (d) Any security breaches or unauthorized access to your LinkedIn account.
Data Processing Agreement
By using Third-Party Authentication, you acknowledge that:
- We act as a data controller for the information we receive from LinkedIn
- LinkedIn acts as a separate data controller under GDPR
- Our processing of your LinkedIn data is governed by our Privacy Policy
- You have separate rights under GDPR with respect to both us and LinkedIn
Compliance with LinkedIn's Terms
You agree not to:
- Use Third-Party Authentication in any manner that violates LinkedIn's API Terms of Use
- Attempt to circumvent any technical limitations imposed by LinkedIn
- Use automated means to access LinkedIn's authentication services
5. Pricing and Payment Terms
The platform may offer both free and paid services. Payments are due in advance and processed via Stripe. All prices are stated exclusive of applicable VAT, unless otherwise specified.
6. Contract Duration and Termination
Contracts are either monthly or annual and renew automatically for the same term unless terminated within the specified notice period. The Customer may terminate their contract at any time via their account settings or by contacting support.
7. Liability and Warranty
The Provider shall only be liable in cases of gross negligence or willful misconduct. Liability for slight negligence applies only in cases of breach of essential contractual duties (cardinal obligations).
8. Data Protection and Confidentiality
The Provider processes personal data in accordance with the Privacy Policy, which is available at Privacy Policy.
9. Usage Rights and Intellectual Property
The Provider grants the Customer a non-exclusive, non-transferable, non-sublicensable right to use the platform. All rights to the software, databases, and the projectfit.ai brand remain with the Provider.
10. Changes to the T&C
The Provider may modify these T&C at any time for legal, technical, or business reasons. Customers will be informed at least 30 days before the changes take effect. If the Customer does not object within this period, the new T&C shall be deemed accepted.
11. Final Provisions
The applicable law is that of the Federal Republic of Germany, unless mandatory consumer protection laws dictate otherwise. The place of jurisdiction is the Provider's registered office, provided the Customer is a business entity.
